Terms of Service

Agreement and eligibility

By accessing or using the Service, creating an account, or submitting content, you agree to these Terms and the Privacy Policy, as well as any additional terms presented for a particular feature. If you do not agree, do not use the Service.

You must be at least 16 years old to create a Torque Score account or submit a community deal. If you are 16 or older but under the age of majority where you live, you may do so only with permission from a parent or legal guardian, who should review these Terms with you.

Torque Score is an information service, not the seller

Torque Score provides shopping information, price-history context, editorial interpretation, ratings, and links to third parties. Torque Score is not the seller, reseller, marketplace, purchasing agent, manufacturer, brand representative, retailer, payment processor, safety professional, fiduciary, or a party to a transaction between you and a retailer or other third party.

Every deal presented as approved by Torque Score may receive human review, but review does not guarantee accuracy, availability, authenticity, suitability, safety, savings, inventory, fulfillment, or continued eligibility. A Torque Score Rating is Torque Score’s subjective editorial interpretation of deal quality. It is not a warranty, appraisal, scientific measurement, safety advice, investment advice, or statement made by a listed brand or retailer.

Confirm offers and products yourself

Prices, promotions, coupons, variants, inventory, shipping, taxes, membership terms, geographic restrictions, exclusions, expiration dates, returns, warranties, and other retailer terms may change without notice. You are responsible for confirming the exact product and final terms before purchasing. The retailer or other third party—not Torque Score—is responsible for its products, representations, transaction, privacy practices, fulfillment, customer service, returns, warranties, and legal compliance.

No trade or product-safety advice

Torque Score does not provide trade, engineering, electrical, workplace-safety, repair, installation, or other professional advice, and does not represent that a product is appropriate or safe for a particular task. Product claims belong to the party making them. Review current manufacturer information and consult a qualified professional for technical or safety questions.

Accounts

• Provide accurate information and keep it reasonably current.
• Protect your credentials, use a password you do not reuse elsewhere, and promptly report suspected unauthorized access.
• You are responsible for activity through your account to the extent permitted by law.
• We may require verification, reauthentication, or other reasonable security steps.
• We may suspend, restrict, or terminate an account or feature when reasonably necessary for security, legal compliance, investigation, misuse, or enforcement of these Terms.

Acceptable use

• Do not violate law or infringe intellectual-property, privacy, publicity, contractual, or other rights.
• Do not submit false, fabricated, manipulated, stolen, malicious, confidential, or unauthorized information, or impersonate another person or company.
• Do not conceal a material relationship to a brand, retailer, affiliate, advertiser, sponsor, or competitor when that relationship is relevant to content you submit.
• Do not probe, bypass, disable, overload, disrupt, reverse engineer, or interfere with security, authentication, rate limits, access controls, source integrity, accounts, or normal Service operation except to the extent a restriction is prohibited by law.
• Do not use bots, scraping, automated extraction, bulk access, or data-mining tools without our prior written permission, except ordinary public search-engine indexing that follows our published instructions.
• Do not use the Service or its content to facilitate fraud, distribute malware, harass others, manipulate ratings or submissions, send spam, or create an unauthorized competing database or model-training dataset.

Community submissions and user content

Community submissions are subject to the Community Deal Submission Terms below. They do not publish automatically. Torque Score may verify, edit, combine, annotate, decline, remove, archive, or otherwise moderate a submission without an obligation to publish, explain, attribute, compensate, or preserve it.

You retain any ownership you lawfully hold in original content you submit. By submitting text, links, images, screenshots, photos, or other material through a feature that accepts such content, you grant Torque Score and its successors a worldwide, nonexclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, verify, analyze, adapt, edit, translate, display, distribute, publish, archive, and otherwise use that content and derived nonpersonal deal information for operating, protecting, promoting, and improving the Service, to the extent permitted by law. This license does not give Torque Score ownership of third-party material you did not own or have authority to submit.

Intellectual property and third-party rights

Torque Score’s name, visual identity, arrangement, original text, software, design, charts, editorial annotations, ratings, and other original Service elements are owned by Torque Score or its licensors and are protected by applicable law. Subject to these Terms, Torque Score grants you a limited, personal, revocable, nonexclusive, nontransferable license to use the Service for lawful personal shopping purposes.

Product names, images, logos, retailer names, and other third-party material remain the property of their respective owners. Their appearance is for identification, comparison, commentary, or other lawful purposes and does not imply sponsorship, endorsement, authorization, or affiliation unless expressly stated.

Copyright, trademark, and correction concerns

Rights holders, brands, retailers, and users may report an alleged copyright, trademark, attribution, impersonation, price, product-safety, or other concern to support@torquescore.com. Include enough information for us to identify the material and evaluate the request. We may preserve relevant evidence, seek verification, restrict access, correct information, or remove material while reviewing a report. We may terminate or restrict repeat infringers or repeat abusers where appropriate. A report does not guarantee a particular outcome or waive any rights or defenses.

Affiliate links and future sponsored content

Torque Score may earn commissions from affiliate links. Sponsored placements, advertising or sponsorship fees, free or discounted products, marketing email, and other compensated commercial features are not part of the launch Service. If any are introduced later, Torque Score will clearly and conspicuously label material relationships and paid content where users see or act on them. Compensation will not secretly purchase ordinary deal approval or improve an ordinary Torque Score Rating.

Feedback

If you voluntarily provide an idea, suggestion, or feedback about Torque Score, you grant Torque Score a worldwide, perpetual, irrevocable, royalty-free, transferable, sublicensable license to use it without restriction or compensation. Do not send feedback you consider confidential or proprietary.

Third-party services

Links, integrations, and references to third parties are provided for convenience and information. Torque Score does not control and is not responsible for a third party’s content, availability, security, terms, privacy practices, products, actions, or omissions. Your dealings with third parties are between you and those parties.

Service changes and availability

We may add, change, suspend, limit, or discontinue any part of the Service; correct errors; change presentation or rating interpretations; remove a deal; or impose reasonable usage limits. We do not promise continuous, uninterrupted, secure, or error-free access, or that any particular content will remain available indefinitely.

Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TORQUE SCORE AND THE TORQUE SCORE PARTIES DISCLAIM ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, SECURITY, AND WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT A DEAL IS THE LOWEST PRICE, THAT A PRODUCT IS GENUINE OR SUITABLE, THAT A RETAILER WILL HONOR AN OFFER, THAT CONTENT IS COMPLETE OR CURRENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED OR FREE OF HARMFUL COMPONENTS. SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS, SO SOME OF THESE TERMS MAY NOT APPLY TO YOU.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TORQUE SCORE, ITS AFFILIATES, LICENSORS, SERVICE PROVIDERS, AND REPRESENTATIVES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOST PROFITS, REVENUE, DATA, SAVINGS, GOODWILL, OR OPPORTUNITY; PERSONAL INJURY OR PRODUCT HARM CAUSED BY A THIRD-PARTY PRODUCT; OR A THIRD PARTY’S ACTS, OMISSIONS, TERMS, TRANSACTION, OR SECURITY, EVEN IF ADVISED OF THE POSSIBILITY. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF THE TORQUE SCORE PARTIES FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID TORQUE SCORE FOR THE SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. THESE LIMITATIONS DO NOT APPLY TO LIABILITY THAT CANNOT LAWFULLY BE LIMITED.

Indemnity

To the maximum extent permitted by law, you will defend, indemnify, and hold harmless the Torque Score parties from third-party claims, losses, liabilities, damages, judgments, penalties, costs, and reasonable attorneys’ fees arising from your unlawful or unauthorized use of the Service, your submission or content, your breach of these Terms, or your infringement or violation of another person’s rights. This section does not require you to indemnify a Torque Score party for that party’s own unlawful conduct where prohibited by law.

Informal dispute process

Before filing a claim, you and Torque Score agree to send a written notice describing the dispute, requested relief, and supporting facts to support@torquescore.com and allow 60 days for a good-faith attempt to resolve the dispute, except where emergency relief, intellectual-property rights, unauthorized system access, a limitations period, or applicable law makes that process unavailable or inappropriate.

Governing law and venue

Oregon law governs without regard to conflict-of-law rules, except that mandatory consumer protections of your home jurisdiction continue to apply. To the extent permitted by law, you and Torque Score consent to jurisdiction in the state and federal courts serving Torque Score's principal place of business in Oregon.

Termination

You may stop using the Service at any time and may delete an eligible account. We may suspend or terminate access when reasonably necessary to protect the Service or others, comply with law, investigate conduct, or enforce these Terms. Provisions that by their nature should survive—including intellectual property, content licenses, disclaimers, liability limits, indemnity, dispute provisions, and general terms—survive termination.

Changes to these Terms

We may update these Terms. We will post the revised version with an effective date and provide additional notice or seek renewed acceptance when required. Material changes apply prospectively to the extent required by law.

General terms

These Terms and policies incorporated by reference are the entire agreement concerning the Service. If a provision is unenforceable, it will be enforced to the maximum lawful extent and the remainder remains effective. A waiver must be in writing and is not a continuing waiver. You may not assign these Terms without our consent; we may assign them in connection with a reorganization, financing, sale, or transfer. We are not responsible for delay caused by events beyond reasonable control. These Terms do not create an agency, partnership, employment, fiduciary, franchise, or joint-venture relationship.
